Article 1 – Definitions
In these Terms & Conditions, the following definitions apply:
- Entrepreneur: Trap Cosmetics, represented by S. Mahboubi and N. Weddell, established in the Netherlands, offering products and/or services to consumers through physical and online sales channels.
- Consumer: Any natural person acting for purposes outside their trade, business, or profession who enters into an agreement with the Entrepreneur.
- Agreement: Any arrangement or contract between the Entrepreneur and the Consumer regarding the purchase of products or services.
- Distance Agreement: An agreement concluded through a system organized for distance selling, using one or more means of remote communication.
- Means of Distance Communication: Any method enabling an agreement to be concluded without both parties being physically present at the same time.
- Cooling-Off Period: The period during which the Consumer may exercise the right of withdrawal for distance purchases.
- Right of Withdrawal: The Consumer’s right to cancel a distance agreement within the statutory cooling-off period.
- Day: A calendar day.
- Continuous Transaction: An agreement involving recurring deliveries of products or services over a period of time.
- Durable Data Carrier: Any tool enabling information to be stored for future consultation and unchanged reproduction, such as email or cloud storage.

Trap Cosmetics operates in Europe through both physical sales locations and online sales channels.
Article 3 – Applicability
- These Terms & Conditions apply to all offers, agreements, and deliveries by Trap Cosmetics.
- By placing an order or making a purchase, the Consumer agrees to these Terms & Conditions.
- Any deviations are only valid if confirmed in writing by Trap Cosmetics.
- If any provision is declared invalid, the remaining provisions remain fully applicable.
Article 4 – Formation of the Agreement
- All offers and price quotations are non-binding unless stated otherwise.
- An agreement is concluded once Trap Cosmetics confirms the order by email or in writing.
- Trap Cosmetics reserves the right to refuse orders without providing reasons.
- The Consumer is responsible for providing accurate and up-to-date information.
- Obvious typographical or pricing errors are not binding.
Article 5 – Prices, Rates & Stock
- All prices are listed in Euros (€) and include VAT unless stated otherwise.
- For international orders, prices may vary due to exchange rates or transaction fees.
- Pricing errors or technical mistakes do not entitle the Consumer to compensation.
- Trap Cosmetics may adjust prices due to market conditions or legal obligations.
- Promotions and discounts are temporary and valid while supplies last.
- If a product becomes unavailable after ordering, the Consumer will be informed and refunded.
- Additional costs such as shipping or import duties will be clearly communicated before checkout.
Article 6 – Payment
- Payment must be completed before products or services are delivered.
- Accepted payment methods include iDEAL, PayPal, credit card, bank transfer, and other available payment options.
- If payment is incomplete or delayed, Trap Cosmetics may suspend or cancel the order.
- Additional international transaction costs may apply where relevant.
Article 7 – Delivery & Shipping
- Delivery times are estimates and not guaranteed deadlines.
- Delays do not entitle the Consumer to compensation unless legally required.
- If delivery exceeds 30 days, the Consumer may cancel the agreement free of charge.
- Trap Cosmetics delivers within Europe unless otherwise agreed.
- The Entrepreneur is not liable for incorrect delivery caused by inaccurate customer information.
- If the Consumer gives permission for unattended delivery, the delivery risk transfers upon confirmation of delivery.
- Failure to collect a package may result in return costs charged to the Consumer.
Article 8 – Returns, Hygiene & Defects
Due to health protection and hygiene reasons, cosmetic products cannot be returned once delivered.
- The right of withdrawal is excluded under Article 6:230p sub e of the Dutch Civil Code and EU Consumer Rights Directive 2011/83/EU.
- Opened or unsealed products cannot be returned.
- Defective or damaged products must be reported within 72 hours after delivery with photo evidence.
- If the complaint is approved, a replacement product may be provided.
- Refunds are only possible if replacement is not reasonably possible.
Article 9 – Complaints & Warranty
- The Consumer must inspect products immediately upon delivery.
- Complaints must be submitted within 14 days after discovering the issue.
- Minor variations in packaging or appearance do not constitute defects.
- Warranty claims are void in cases of misuse, negligence, or improper storage.
- If a complaint is valid, Trap Cosmetics may repair, replace, or partially refund the product.
Article 10 – Website Use
- All intellectual property rights related to the website belong to Trap Cosmetics or its licensors.
- Website content may not be copied or distributed without written permission.
- Trap Cosmetics cannot guarantee the website is always accurate or uninterrupted.
- External links are provided for convenience only and remain the responsibility of third parties.
Article 11 – Liability
- The Consumer must carefully follow all product instructions and warnings.
- Trap Cosmetics is not liable for damage resulting from improper use of products.
- Trap Cosmetics is not responsible for allergic reactions, irritation, or other side effects.
- Liability is limited to the amount covered by the company’s liability insurance or the invoice amount of the product concerned.
- Indirect or consequential damages are excluded unless mandatory law states otherwise.
Article 12 – Force Majeure
- Trap Cosmetics is not liable for delays or failures caused by circumstances beyond its control.
- Force majeure includes natural disasters, pandemics, strikes, government measures, transport disruptions, supplier failures, and similar events.
- Trap Cosmetics may suspend or terminate the agreement during force majeure situations without liability.
Article 13 – Complaints & Dispute Resolution
- Complaints must be submitted within 7 days after discovering the issue.
- Trap Cosmetics will confirm receipt within 14 days.
- If a complaint cannot be resolved amicably, it may become subject to dispute resolution.

Article 14 – Governing Law & Disputes
- All agreements are governed exclusively by Dutch law.
- Disputes will be submitted to the competent Dutch court unless mandatory law provides otherwise.
- Parties will first attempt to resolve disputes amicably or through mediation.
- The Vienna Sales Convention (CISG) is expressly excluded.
Article 15 – Additional Provisions
Any additional agreements or deviations from these Terms & Conditions are only valid if agreed upon in writing between Trap Cosmetics and the Consumer. Such provisions may never disadvantage the Consumer and must be stored in a durable and accessible manner.
